Squids Dive Co – Terms and Conditions for Dive Sessions & Courses

Introduction

These Terms and Conditions govern participation in any dive sessions, courses, certifications, training programs, and related activities offered by Squids Dive Co. By booking or participating in our services, you agree to these Terms and Conditions. Please read carefully.

1. Eligibility

1.1 All participants must be at least 18 years old or have written parental/guardian consent if under 18.

1.2 Participants must complete all required waivers, forms and medical questionnaires prior to participation.

1.3 You must disclose any medical conditions, medications, injuries, pregnancy, or other health-related matters that may impact your ability to safely participate. Failure to disclose relevant information may result in refusal of participation without refund.

1.4 Where medical clearance is required based on questionnaire responses, participation cannot proceed until written medical approval has been provided.

2. Booking and Payment

2.1 Full payment is required at the time of booking unless a course payment plan has been approved.

2.2 Payments can be made through our website, approved booking systems, bank transfer or other approved payment methods.

2.3 All bookings are subject to availability and confirmation by Squids Dive Co.

Course Payment Plans

2.4 For eligible certification courses, a payment plan may be available consisting of:

  • A 50% non-refundable deposit payable at booking.

  • The remaining balance due no later than 7 days prior to course commencement

2.5 The deposit covers administration, scheduling and eLearning costs and is non-refundable.

2.6 Failure to pay the remaining balance at least 7 days prior to the course commencement date may result in removal from the course and release of your position to another participant.

2.7 Any approved transferred payments or credits must be used within 12 months of the original booking date, subject to availability.

2.8 Full payment must be received prior to course commencement. If payment has not been received in full by the required due date, the dive and/or course will not proceed for that participant until payment is completed.

3. eLearning and Course Requirements

3.1 Where eLearning is included as part of a course, access may be issued following booking confirmation and completion of required documentation.

3.2 All required medical questionnaires and documentation must be completed and approved prior to eLearning access being issued.

3.3 Participants are responsible for completing all required eLearning and theory components no later than 24 hours prior to course commencement, unless otherwise advised.

3.4 Failure to complete medical requirements and/or eLearning within the required timeframe may result in removal from the course and will be treated as a late cancellation, with cancellation fees applying.

3.5 Once eLearning access has been released, activated, or course materials have been issued, associated eLearning fees are non-refundable regardless of attendance, cancellation, withdrawal, medical inability to continue, or course completion status.

4. Cancellations, Transfers and Refunds

4.1 All Squids Dive Co sessions operate subject to safe weather conditions, suitable environmental conditions, instructor availability and minimum participant numbers.

4.2 Squids Dive Co reserves the right to postpone, relocate, reschedule or cancel any session if conditions are considered unsafe, unsuitable, unpleasant for participant experience, or minimum numbers are not met.

4.3 If Squids Dive Co cancels a session, participants will be offered:A full refund; orThe option to transfer to another available date.

4.4 If a participant chooses to cancel or reschedule:

  • Cancellations made 14 days or more prior to session commencement will receive a full refund less booking fees, or one free transfer to another available session.

  • Cancellations made within 14 days of session commencement will receive a 50% refund less booking fees, or 50% booking credit to transfer to another available session.

  • Cancellations made within 72 hours of session commencement are non-refundable and not eligible for credit or transfer.

4.5 No-shows, arriving late, failure to attend, being unavailable at the scheduled meeting time, or failure to meet course prerequisites (including medical approval and eLearning completion requirements) may be treated as a cancellation and are not eligible for refund or credit.

4.6 To cancel, transfer, or request changes to your booking, participants must contact Squids Dive Co directly via email or phone.

5. Safety Requirements and Participation

5.1 All participants must follow all instructions provided by Squids Dive Co instructors, guides and staff at all times.

5.2 Participants must hold the required certification, fitness level, experience and prerequisites applicable to their session.

5.3 Failure to comply with safety requirements may result in exclusion from participation without refund.

5.4 Squids Dive Co reserves the right to refuse participation where safety, environmental conditions, health concerns or participant wellbeing may be compromised.

5.5 Diving certification is performance-based and certification is not guaranteed.

5.6 Participants must demonstrate the required standards including but not limited to:Completion of theory requirementsSwim requirementsWater confidenceEqualisation abilitySafety proceduresPractical skill performanceAgency-required certification standards

5.7 If a participant does not successfully complete course requirements within scheduled course time:Additional training sessions may be requiredCourse extension fees may applyPrivate coaching may be offered at additional costCertification may be delayed until standards are achieved

6. Certification Requirements

6.1 Certification will only be issued once:

  • All course payments have been received in full

  • eLearning and theory requirements have been completed

  • Required practical skills and performance standards have been achieved

  • Instructor sign-off has been completed

6.2 Squids Dive Co instructors retain final discretion regarding certification approval in accordance with training agency standards.

7. Liability and Insurance

7.1 Squids Dive Co will take all reasonable steps to promote participant safety; however, participation occurs at your own risk.

7.2 Squids Dive Co is not liable for injury, death, loss, equipment damage, delays, or other loss except where caused by our negligence.

7.3 Participants are strongly encouraged to hold appropriate personal dive insurance.

8. Equipment

8.1 Participants are responsible for maintaining their own equipment unless rental equipment is provided.

8.2 Rental equipment must be returned in the same condition as supplied.

8.3 Damage, excessive cleaning, loss or replacement costs may be charged to the participant.

8.4 Participants are responsible for ensuring personal equipment is fit for purpose and suitable for the planned activity.

9. Media Consent

9.1 By participating in Squids Dive Co activities, you consent to photos and videos being captured during sessions and used for promotional purposes including social media, website content and marketing.

9.2 If you do not wish to appear in media content, you must notify Squids Dive Co in writing prior to participation.

10. Code of Conduct

10.1 We aim to create a respectful, supportive and inclusive environment.

10.2 Harassment, discrimination, intoxication, unsafe behaviour or disruption may result in immediate removal without refund.

11. Changes to Terms

11.1 Squids Dive Co reserves the right to amend these Terms and Conditions at any time.
